Terms of use
1. Identification and contact
Appet.tosa is a management software for pet grooming (bath and trim) services and petshop routines, available via web and apps.
The service provider and platform operator is WLTS Inovações Ltda, CNPJ 49.608.263/0001-77, headquartered in Barretos, São Paulo, Brasil (“Appet.tosa”, “we”, “us”).
These Terms apply to the use of Appet.tosa through official domains and applications, including, for example: appettosa.com.br, web.appettosa.net, appettosa.pt and mobile apps (Android/iOS).
2. Acceptance and relationship with the Privacy Policy
By accessing, registering, logging in or using Appet.tosa, you confirm that you have read and agree to these Terms and the Privacy & Data Protection Policy (together, the “Documents”).
If you do not agree with any part, you must not use the service.
If there is any conflict between these Terms and the Privacy Policy, the following prevails:
(i) the Privacy Policy for personal data matters; and
(ii) these Terms for usage rules, subscriptions and responsibilities.
3. Key definitions
For ease of reading:
• “User” or “you”: the person who accesses and/or uses Appet.tosa.
• “Customer”: the company/establishment (petshop/grooming business) that subscribes to a plan and manages internal users.
• “Pet owners” or “end customers”: individuals served by the petshop/groomer whose data may be entered into Appet.tosa by the Customer.
• “Content”: information entered into the system (e.g., schedule, services, sessions, records, notes, reports).
• “Service”: Appet.tosa and its features, including notifications and integrations.
4. Eligibility and registration
To create an account and use the Service, you must be at least 18 years old and legally capable of accepting these Terms.
You agree to provide true, complete and up-to-date information and to keep it accurate over time.
You are responsible for keeping your credentials confidential and for not sharing your account. Any activity carried out through your account will be deemed your responsibility.
If you suspect unauthorized use, you must notify us promptly and/or change your credentials.
5. Plans, trial and subscription
Appet.tosa may offer free trials, paid plans and additional features. Commercial conditions (prices, term, resources and limits) may vary and will be presented at the time of subscription.
Unless otherwise stated, free trials are intended for new customers and may have usage restrictions.
The Customer is responsible for ensuring that its team’s use complies with these Terms.
6. Payments, renewal and payment providers
Payments may be processed by third-party providers (“Payment Providers/Gateways”) depending on the selected method and the Customer’s country/region.
In Brazil, we may offer payment by credit card (Pagar.me S/A), PIX (Banco Cooperativo Sicredi) and PIX Recorrente (Recurring PIX), subject to availability. For international collections, we may use Stripe Brasil.
Full card details are not stored by Appet.tosa. Financial information may be processed directly by the Payment Provider under its terms and policies.
Where applicable, subscriptions may renew automatically (for example, via recurring card charges). In Brazil, renewal/collection may also occur via Recurring PIX, subject to availability, payer authorization and provider rules. Renewal will occur while authorization remains valid and sufficient balance/limit is available.
Taxes, bank fees and any payment-method charges may apply under applicable law and the Payment Provider’s rules.
7. Cancellation, suspension and termination
You may request cancellation through the options available in the product (or via support), subject to any paid period and plan rules.
In case of late payment, failure, discrepancy or chargeback, we may suspend access until the issue is resolved to protect the Service and prevent fraud.
Termination/cancellation may result in loss of access and, after the retention period described in the Privacy Policy, deletion or anonymization of data where applicable and legally permitted.
We may terminate or suspend accounts and access, with or without prior notice, if there is:
(i) breach of these Terms;
(ii) security risk;
(iii) legal requirement;
(iv) abusive or unlawful use or use that harms third parties.
8. Service use and prohibited conduct
You agree to use the Service lawfully and responsibly, respecting third-party rights and applicable laws (including data protection and consumer laws where relevant).
Prohibited conduct includes, for example:
• attempting to access third-party accounts, bypass security, circumvent limits, exploit vulnerabilities or interfere with the Service’s operation;
• using the Service to send spam or unlawful, offensive, discriminatory or rights-infringing content;
• collecting data without authorization, performing improper scraping, or processing personal data without a lawful basis;
• copying, reproducing, distributing, modifying or creating derivative works from the Service without express authorization.
9. Customer-entered Content and responsibility
Content entered into Appet.tosa (records, schedules, notes, pet owner and pet data, etc.) is the responsibility of the Customer/User who entered it.
You represent that you have the authorization and lawful basis to enter and process third-party personal data (e.g., pet owners) and that you will provide transparency and contact mechanisms where required by law.
Appet.tosa is not responsible for misuse of the Service by the Customer/User, including incidents caused by compromised credentials, misconfiguration, shared access, or unauthorized data collection by third parties.
10. WhatsApp and SMS notifications (Twilio and WhatsApp Business)
Appet.tosa may send notifications related to pet grooming services and system use via WhatsApp and/or SMS, depending on Customer settings and technical availability.
Where applicable, Appet.tosa may use Twilio as an infrastructure provider to enable SMS delivery and technical delivery reports. For this purpose, we may share only the necessary data with Twilio (e.g., recipient number, message content and delivery metadata), as described in the Privacy Policy.
When the Customer uses its own WhatsApp Business account via QR Code scan, messages are sent from the Customer/petshop number. In this model, the Customer is responsible for:
• obtaining and maintaining required authorizations/consents and preferences (opt-out) where required;
• complying with WhatsApp/Meta policies and applicable laws;
• ensuring message content is strictly related to the service (sessions, confirmations and pet grooming information).
Appet.tosa is not responsible for blocks, restrictions, penalties or unavailability of WhatsApp/Meta arising from Customer misuse or provider policies.
11. Intellectual property and license
Appet.tosa, its trademarks, logos, software, interfaces, texts and other elements are protected by intellectual property laws. Using the Service does not grant you any ownership rights over these elements.
We grant you a limited, revocable, non-exclusive and non-transferable license to access and use the Service solely for your internal business purposes while your account is active and compliant with these Terms.
12. Third-party services and links
The Service may integrate with or reference third-party services (for example, WhatsApp/Meta, Twilio, payment gateways and app stores) and may contain external links.
We do not control these third parties and are not responsible for their products, policies, outages or practices. Use of those services may be subject to their own terms and policies.
13. Availability, updates and support
We strive to keep the Service available with commercially reasonable care, but outages, maintenance and temporary unavailability may occur.
We may update, modify, discontinue features or change limits/resources, with or without notice, subject to legal obligations and applicable contracts. For material changes, we will seek to provide notice through reasonable channels.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, 100% secure at all times, or fit for a particular purpose.
Nothing in these Terms limits warranties that cannot be excluded by law (for example, mandatory consumer rights where applicable).
15. Limitation of liability
To the maximum extent permitted by law, Appet.tosa will not be liable for indirect, incidental, special, consequential damages or lost profits, loss of data, business interruption, or damages arising from third-party misuse of the Service.
Where liability cannot be excluded, it will be limited to the minimum permitted by law and, where applicable, to the amounts actually paid by the Customer to Appet.tosa in the 3 (three) months preceding the event giving rise to the claim, unless the law provides otherwise.
16. Indemnification
You agree to indemnify and hold Appet.tosa harmless from claims, losses, damages, fines and expenses (including legal fees) arising from:
(i) breach of these Terms;
(ii) unlawful use of the Service;
(iii) infringement of third-party rights;
(iv) processing personal data without a lawful basis or in violation of the Privacy Policy.
17. Changes to these Terms
We may update these Terms from time to time. The current version will be available on our official channels with the updated date.
By continuing to use the Service after changes take effect, you agree to the revised Terms. If you do not agree, you must stop using the Service and request cancellation where applicable.
18. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Barretos/SP are elected as the venue, except where mandatory laws require otherwise (for example, applicable consumer protection rules).
For users outside Brazil, we may adopt transparency practices and rights aligned with applicable local laws, as described in the Privacy Policy, without waiving the governing law and venue in this section where permitted.
19. General provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Any failure to enforce a provision shall not constitute a waiver of rights.
